If you are using How Often on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must be at least 13 years of age to use How Often. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.
How Often is currently available in jurisdictions where it is permitted by applicable law. We make no representation that the App is appropriate or available in all locations.
Some features of How Often — such as cloud backup and cross-device sync — require you to create an account. When creating an account, you agree to:
How Often can be used without an account. Local tracking data does not require registration.
You agree to use How Often only for lawful purposes. You must not:
All event logs, patterns, and tracking data you create in How Often belong to you. We do not claim ownership of your data.
By optionally enabling cloud backup, you grant How Often a limited, non-exclusive license to store and sync your data solely for the purpose of delivering the backup service to you. This license terminates when you delete your data or your account.
You can export or delete your data at any time from within the app. We will not retain your tracking data after deletion.
All content, design, software, and materials that make up How Often — excluding your personal tracking data — are owned by or licensed to us and protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, or create derivative works from any part of How Often without our express written permission. The How Often name, logo, and brand elements are our trademarks and may not be used without authorization.
Your use of How Often is governed by our Privacy Policy, which describes how we handle your data. How Often is designed with a local-first, privacy-first approach — your tracking data stays on your device unless you choose to enable cloud backup.
How Often is provided on an "as is" and "as available" basis, without warranties of any kind. We do not warrant that:
To the fullest extent permitted by applicable law, How Often and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.
We may suspend or terminate your access to How Often at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the App or any part of it.
You may stop using the App at any time. To delete your account and all associated cloud data, contact us at the address in Section 13. Local data can be deleted directly from your device.
Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive any termination.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and notify you through an in-app notice where appropriate.
Your continued use of How Often after any update constitutes your acceptance of the revised Terms. If you do not agree, you should stop using the App.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
